Fahrerflucht"},"content":{"rendered":"<p style=\"text-align: justify;\">Das OLG Hamburg hat entschieden, dass keine Unfallflucht vorliegt, wenn der Unfallgesch\u00e4digte auf die Polizei verzichtet \u2013 auch wenn der Unfallbeteiligte seine Personalien nur gegen\u00fcber der Polizei bereit ist feststellen zu lassen \u2013 und der Unfallbeteiligte sich vom Unfallort entfernte.<\/p>\n<h2><strong>Unerlaubtes Entfernen vom Unfallort<\/strong><\/h2>\n<p style=\"text-align: justify;\">Die sogenannte Unfallflucht oder Fahrerflucht ist im Verkehrsstrafrecht regelm\u00e4\u00dfig Ansatzpunkt f\u00fcr strafrechtliche Ermittlungen. In ein solches strafrechtliches Ermittlungsverfahren l\u00e4sst sich mit einem Rechtsanwalt f\u00fcr Strafrecht relativ zeitnah Einfluss nehmen. Sie sollten ferner beachten, dass ab einem bestimmten Fremdschaden sogar die Entziehung der Fahrerlaubnis droht (vgl. \u00a7 69 Abs. 2 Nr. 3 StGB).<\/p>\n<h3><strong>Verzicht des Unfallgesch\u00e4digten<\/strong><\/h3>\n<p style=\"text-align: justify;\">Wenn der Unfallgesch\u00e4digte jedoch auf die Polizei verzichtet, kommt nach Ansicht des OLG Hamburg eine Strafbarkeit wegen Unfallflucht oder Fahrerflucht nicht in Betracht.
