{"id":1793,"date":"2019-05-20T21:04:42","date_gmt":"2019-05-20T20:04:42","guid":{"rendered":"https:\/\/www.rechtsanwalt-rothholz.berlin\/?p=1793"},"modified":"2019-05-20T21:04:42","modified_gmt":"2019-05-20T20:04:42","slug":"handyverstos-freisprecheinrichtung","status":"publish","type":"post","link":"https:\/\/www.rechtsanwalt-rothholz.berlin\/blogartikel\/verkehrsrecht\/handyverstos-freisprecheinrichtung\/","title":{"rendered":"Handyversto\u00df \u2013 Freisprecheinrichtung?"},"content":{"rendered":"<p style=\"text-align: justify;\">Das Kammergericht Berlin hat das Urteil des Amtsgerichts Tiergarten wegen Versto\u00dfes gegen \u00a7 23 Abs. 1a StVO aufrechterhalten, weil der Autofahrer das hei\u00df gelaufene Mobiltelefon w\u00e4hrend der Fahrt vor den L\u00fcfter hielt, um so das Handy zu k\u00fchlen und das laufende Telefonat w\u00e4hrend der Fahrt \u00fcber die Freisprecheinrichtung fortzusetzen.<\/p>\n<h3><strong>Halten oder Benutzen?<\/strong><\/h3>\n<p style=\"text-align: justify;\">W\u00e4hrend das OLG Celle in Auslegung der Vorschrift das Benutzen des Handys voraussetzt, hat u.a. das OLG Oldenburg etwa 2018 entschieden, dass ein blo\u00dfes \u201ein der Hand halten\u201c rausreicht. Das Kammergericht hatte dabei \u00fcber eine Kombination beider varianten zu entscheiden. Das Gespr\u00e4ch lief zwar \u00fcber die Freisprecheinrichtung, sodass das Mobiltelefon nicht in der Hand gehalten werden musste, das Telefon wurde jedoch dennoch in der Hand vor dem L\u00fcfter gehalten, um das aktive Gespr\u00e4ch aufgrund der \u00dcberhitzung aufrecht zu erhalten.<\/p>\n<h3><strong>Kammergericht Berlin<\/strong><\/h3>\n<p style=\"text-align: justify;\">Nach Auffassung des Kammergerichts Berlin soll der \u00a7 23 Abs. 1a StVO verhindern, dass der Autofahrer von der konzentrierten Autofahrt abgelenkt wird. Das F\u00fchren eines Kraftfahrzeugs erfordert daf\u00fcr beide H\u00e4nde f\u00fcr die Fahraufgabe, wobei das f\u00fchren eines Telefonts u.a. davon ablenkt. Insofern l\u00e4sst das Kammergericht in Auslegung der Neuregelung des \u00a7 23 Abs. 1a StVO gen\u00fcgen, dass das Handy in der Hand gehalten wird \u2013 auch wenn bei Vorliegen einer Freisprecheinrichtung \u2013 nicht erforderlich ist.
